İbadetlerde Furûk-u fıkhiyye konularının tespit ve tahlili (İmrânî'nin el-Beyân adlı eseri bağlamında)

Abstract

Furûk-u fıkhiyye, fıkhî meselelerin sûreten benzer yönleri ile aralarındaki farkları araştıran ve ortaya çıkaran ilmin adıdır. Zamanla fıkhın bir alt disiplini olarak temayüz etmiştir. Çalışma h. 489 ile 558 yılları arasında Yemen'de yaşamış Şâfiî mezhebine mensup İmrânî'nin "el-Beyân" adlı eserinin, ibadetler bölümünde yer alan "Furûk-u fıkhiyye" meselelerinin tespit ve tahlilidir. Bu nedenle öncelikli olarak eserde yer alan furûk-u fıkhiyye ile alakalı örnekler incelenmiştir. Bir sonraki adımda furûk'un şartlarını taşıyan örnekler konu başlıklarına göre tasnif edilmiştir. Çalışmanın amacı Furûk-u fıkhiyye örneklerini tahlil ederek fıkıh melekesinin artması ve fıkıh mantalitesinin gelişimine katkı sağlamak. İslam hukuku mirasının daha iyi anlaşılmasını sağlamakla beraber İmrâni ve el-Beyân adlı eserinin daha iyi tanıtılmasını amaçlamaktadır. Çalışma, bir giriş ve üç bölümden oluşmaktadır. Giriş bölümünde araştırmanın konusu, amacı, kapsamı ve önemi hakkında bilgiler verilmiştir. Birinci bölümde İmrânî'nin yaşadığı toplumun ilmi ve siyasi durumu, müellifin hayatı, eserleri, hocaları hakkında izahatta bulunulmuştur. İkinci bölümde Furûk-u fıkhiyye'nin mahiyeti, önemi, kendisiyle ilintili olan kavramlar ve tarihsel süreçte geçirmiş olduğu evreler ele alınmıştır. Üçüncü bölümde el-Beyân eserindeki ibadetler konu başlığında ele alınan Kitabu't-taharet, Kitabu's-salât, Kitabu'l-cenâiz. Kitabu'z-zekât, Kitâbus-sıyam ve Kitabu'l-hac ile ilgili 60 furûk örneği incelenmiş ve tespit edilen her örneğin akabinde meselenin tahlili yapılmıştır. Eser geniş ve mufassal olduğundan bunların içerisinden sadece furûk-u fıkhiyye'nin ruhunu ve mantalitesini öne çıkaran meseleler ele alınmıştır. Yapılan incelemeler neticesinde Furûk-u fıkhiyye örneklerinin tespit ve tahlilini yapabilmek için nas ve dil bilgisinin yanında fıkıh melekesinin de olması gerektiği sonucuna varılmıştır.

Fur?q al-fiqhiyya is the name of the science that investigates and reveals the similar aspects of jurisprudential issues and the differences between them. Over time, it has gained prominence as a subdiscipline of fiqh. The aim of this study is to examine the history of jurisprudence in Yemen between 489 and 558 AH. 489 and 558, the aim of the study is to identify and analyze the issues of "Fur?k-u fiqhiyya" in the section of worship in the work "al-Bayân" of Imrân?, a member of the Shâfi'i sect who lived in Yemen between 489 and 558. For this reason, first of all, the examples related to fur?k-u fiqhiyya in the work are analyzed. The next step is to classify the examples that fulfill the conditions of fur?k according to the subject headings. Then, the nuance that causes similar issues to be ruled differently is explained. The study consists of an introduction and three chapters. The introduction provides information about the subject, purpose, scope and importance of the study. In the first chapter, the scholarly and political situation of the society in which Imran? lived, the author's life, his works, and his teachers are explained. In the second chapter, the nature and importance of Fur?q al-fiqhiyya, the concepts related to it, and the stages it has gone through in the historical process are discussed. In the third chapter, the book of al-Bayân in the section of worship, Kitab al-taharah, Kitab al-salât, Kitab al-janâiz. Kitab al-zakât, Kitâb al-siyâm, and Kitab al-haj, 60 examples of fur?k were analyzed and each example was followed by an analysis of the issue. Since the work is large and comprehensive, only the issues that highlight the spirit and mentality of fur?q al-fiqhiyya are analyzed.
