Elcezire İstiklâl Mahkemesi Üyesi Mehmet Yasin Sani Kutluğ'un Hayatı ve Yasama Faaliyetleri (1889-1973)

Abstract

tiklal Mahkemeleri, kuruluş gayeleri ve işleyişleri bakımından devamlı suretle tartışma konusu olmuştur. İlk defa Kurtuluş Savaşı yıllarında kurulan bu mahkemelere Cumhuriyetin ilk yıllarında da rastlanmaktadır. Cumhuriyetin ilanından evvel kurulmuş olan son İstiklâl Mahkemesi olan Elcezire İstiklâl Mahkemesi’dir. Elcezire Cephesi Kumandanlığının talebi üzerine 22 Ocak 1923 tarihinde Meclis’te yapılan müzakereler sonucunda kurulmuştur. Asker kaçakları, bunlarla ilgili suçlara bakmak üzere kurulan ve merkezi Diyarbakır’da olan bu gezici mahkeme Elcezire Cephesi’ni ihtiva eden Diyarbakır, Bitlis, Elaziz, Malatya, Urfa, Mardin, Siverek, Ergani, Genç, Muş, Siirt illerini kapsayan geniş bir bölgeden sorumlu olup, toplam doksan davayı karara bağlamıştır. Mahkeme üyelerinin seçimi sonucunda görev alan beş üyeden biri de I. Dönem Gaziantep Mebusu Yasin Bey (Mehmet Yasin Sani Kutluğ) idi. Bu çalışmada Elcezire İstiklâl Mahkemesi’nin kuruluş süreci ile bu mahkemenin üyeliğini yapmış olan I. Dönem Gaziantep Mebusu, Kırmızı-Yeşil Şeritli İstiklal Madalyası sahibi Yasin Bey’in hayatı ve yasama faaliyetleri ele alınmıştır.

The Independence Courts have been the subject of controversy in the Turkish public opinion in terms of their establishment purposes and operations. These courts, which were established for the first time in the War of Independence, are also encountered in the first years of the Republic. The last Independence Court established before the declaration of the Republic is the Elcezire Independence Court. It was established at the request of the Elcezire Front Command, as a result of the negotiations held in the Assembly on 22 January 1923. This mobile court, which was established to look at soldiers'evasions and related crimes and which is located in Diyarbakır, is responsible for the region that includes Diyarbakir, Bitlis, Elaziz, Malatya, Urfa, Mardin, Siverek, Ergani, Genc, Mus, Siirt provinces. In the process, a total of ninety cases were resolved. As a result of the election of the court members, one of the five members who took office was Yasin Bey (Mehmet Yasin Sani Kutluğ), the first deputy of Gaziantep MP. In this study, the establishment process of Elcezire Independence Court and the life and legislative activities of Gaziantep deputy who was a member of the court and the owner of the Red-Green Lane Independence Medal were discussed.
