TÜRK ANAYASA MAHKEMESI KARARLARI IŞIĞINDA AF YETKISININ KULLANIMI

Abstract

Anayasa’nın 87. maddesine göre Türkiye Büyük MilletMeclisi’nin yetkilerinden biri de genel ve özel af ilanına karar vermektir. Af yetkisine sahip olan Türkiye Büyük Millet Meclisi bu yetkisini ancak bir kanunla kullanabilecektir. Tüm kanunlar gibi af kanunları da Anayasa Mahkemesi’nin yargısal denetimine tabidir. Buçalışmada Anayasa Mahkemesi’nin farklı adlar altında çıkarılsa da afkanunları hakkında vermiş olduğu kararlar ve bu kararların sonuçlarıincelenmeye çalışılmıştır

One of the powers of the Grand National Assembly of Turkey according to Article 87 of the Constitution is to decide on the general and special amnesty announcement. Grand National Assembly of Turkey, has the authority of amnesty but this authority can only be used by an amnesty law. Like all laws, amnesty laws are subject to judicial review by the Constitutional Court. In this study, the decisions of the Constitutional Court on amnesty laws and the results of these decisions are tried to be examined, even if they were issued under different names
