1960-2000 arasında Türkiye'de değişen yönleriyle vatandaşlık ve vatandaşlıktan çıkarılma sorunu

Abstract

Bu tezin amacı vatandaşlık kavramının tarihsel süreç içerisinde değişen muhtevasını ele alarak 1960-2000 yılları arasında Türkiye Cumhuriyeti'nde alınan vatandaşlıktan çıkarılma kararlarını dönemin siyasal ve sosyal olayları ekseninde ele almaktır. Bu amaçla 1960-2000 yılları arasında görev yapan hükümetler ve bu hükümetler döneminde alınan vatandaşlıktan çıkarılma kararları arşiv belgelerinden taranarak baz alınan dönemle ilişkilendirilmiştir. Elde edilen mevcut verilere göre vatandaşlıktan çıkarılmalar devletin talebiyle veya vatandaşın talebiyle alınmış olsun dönemin sosyal, siyasal, kültürel ve ekonomik gelişmelerinden bağımsız değildir. Vatandaşlık kavramına her dönem iç ve dış gelişmelere bağlı olarak yeni anlamlar yüklendiği ve buna paralel olarak her dönemin vatandaşlık anlayışının kapsayıcılığının farklı olduğu sonucunu doğurmuştur. Her ne kadar vatandaşlıktan çıkarılmalar hukuki kararlar olsa da nedenleri ve sonuçları itibariyle aynı zamanda siyasi kararlardır. Bu nedenle siyasi ortam değiştikçe vatandaşlık kavramı da hukuki ve siyasi olarak yeniden şekillenmiştir. Aynı zamanda vatandaşlık kavramı ve vatandaşlıktan çıkarılmaların bir ülkenin dış politikası ve dünyadaki gelişmelerle de yakından ilişkili olduğu saptanmıştır. The aim of this thesis is to examine the changing content of the concept of citizenship in the historical process and to investigate the decisions to remove citizenship taken in the Republic of Turkey between 1960-2000 in the axis of the political and social events of the period. For this purpose, the governments that served between the years of 1960-2000 and the decisions to remove citizenship taken during these governments were scanned from archive documents and associated with the period taken as a basis. According to the available data obtained, deprivation of citizenship is not independent of the social, political, cultural and economic developments of the period, whether at the request of the state or at the request of the citizen. It has resulted that the concept of citizenship has been given new meanings in each period depending on external and internal developments, and in parallel with this, the inclusiveness of the understanding of citizenship in each period is different. Although deprivation of citizenship are legal decisions, they are also political decisions in terms of their causes and consequences. For this reason, as the political environment changed, the concept of citizenship was reshaped legally and politically. At the same time, it has been determined that the concept of citizenship and deprivation of citizenship are closely related to a country's foreign policy and developments in the world.
